Know your rights when being pulled over

AS we approach the busiest time of the year on our roads, authorities will be out in full force to ensure motorists are kept in check. Many questions, however, have been raised regarding the rights of motorists when they are stopped by an official.

Here is what you should know:

1. If authorities flash their blue lights behind you, you are required to pull over. In exceptions where motorists feel unsafe, especially late at night, one is advised to turn on their hazards and drive at a slow speed to the nearest garage or police station. The motorist can then explain to the officer that they felt it was a safer option. It is important to note, that a motorist does not have to commit an offence to be pulled over or have their vehicle inspected.

2. You can request to see the speedometer. If you have been pulled over by authorities for speeding, you are allowed to ask for proof of the speed they said you were travelling at.

3. Know when you can be arrested. You can be arrested if you resist a breathalyzer test or if you are found to be driving over the legal alcohol limit. You can also be arrested for excessive speeding and unpaid fines. Note that in the case of unpaid fines, a warrant has to be issued against you and the document should be presented to you.

4. You have the right to take photographs and videos. An officer cannot prevent you from filming or take away or damage your equipment. You are required to be respectful in such situations as you can be arrested for verbally abusing an officer.

5. You have the right to ask questions. Officers should disclose their name and rank to you and you have the right to ask if they do not. You may write down their vehicle registration number as well as the officer’s badge number.
