Court ruling shocks Mpembeni residents

ONE murder case against eMpembeni accused Justice Ngwane (36) and Meshack Ngwane has had to be withdrawn in the eSikhawini Magistrate’s Court on Tuesday because of a missing witness and lack of evidence.
The men were charged for the murder of Ntuthuko Dladla, who was killed on 13 July last year.
With the investigation showing no progress and the witness with incriminating evidence now missing, the court could find no link between the accused and the killing.
The suspects then appeared in the Ngwelezana Magistrate’s Court for the murder of Wiseman Hadebe, who was killed in a hail of bullets on his way to work earlier this year.
The case was remanded to 8 October.
The two men were arrested in February this year – Justice initially charged with three murders and Meshack facing two murder charges.
Justice is still in police custody, while his uncle was granted R15 000 bail in May.
Angry eMpembeni residents, who packed the court building, were shocked by the court’s decision.
‘Our courts are failing us, but we hope they will charge them again once they get more evidence on the matter,’ said one resident.
‘I knew this was going to happened. They have been postponing these cases many times. It was obvious something like this would happen,’ said Fikile Mthembu.
Community leaders also expressed their dissatisfaction over the ruling.
