UPDATE: Civil case against former municipal manager gains momentum

While the disciplinary charges against Siyabonga Ntuli had to be dropped when he resigned, the civil case is on track.

THE civil case brought against former Mtubatuba Municipal Manager (MM), Siyabonga Ntuli by former Administrator Bamba Ndwandwe has moved to prosecution and is being handled by the Specialised Commercial Crimes Court.

The numerous charges against Ntuli include security tender cases, irregular expenditure, alleged bribery of a police officer, fraudulent tenders and the fraudulent training of traffic police officers.

All charges have been separated and are being investigated one-by-one by the SAPS, starting with the security tender case.

While irregular expenditure at Mtubatuba predates Ntuli’s reign as MM, it is only the R35 313 658 for which he is responsible that can be investigated.

This is owing to the Prescription Act which means irregular expenditure investigations can be back dated no more than three years.

Ndwandwe’s contract at Mtubatuba concluded at the end of July and he is hopeful things will continue on the smooth path he has set. For the first time since 2008, Mtubatuba Municipality’s bank account was a healthy R63-million in the black when Ndwandwe left.

His parting words of advice were, ‘Take extreme care in building on cash liquidity’.
