Day of justice for rape survivor

THE survivor of a harrowing robbery and rape ordeal is rejoicing following the successful conviction of three of her attackers, including her rapist.

The three men were convicted in the Richards Bay Regional Court after almost five years since the incident.

Bravely facing her rapist and attackers, Vanessa (surname withheld) said she chose to live and survive by any means so she could see the faces of her children again.

‘There is life after rape and I am choosing to live my life to the fullest. This will bring me closure.’

Regional Prosecutor Sharon Bux and investigating officer, Warrant Officer Ryno Louw, as well as a private detective hired by Vanessa and many other committed members of the justice system, worked together to build the case against the three.

Bhekisisa Mbhekiseni Buthelezi, Lucky Bheki Ndlovu and Sithembiso Vusi Nkwanyana were convicted of robbery with aggravating circumstances acting in common purpose, theft and fraud.

Nkwanyana was also convicted of raping Vanessa.

In his judgement, Regional Court Judge Logan Naidoo said: ‘All the evidence fit together like a hand in a glove. Accused number two is a hardened and accomplished criminal, but a pathetic liar.’

Nkwanyana submitted a statement admitting his part and was convicted on his own statement and an identification parade.

Buthelezi told the court he was forced to participate, but his evidence was rejected.

Vanessa was attacked in November 2010 on the N2 between Hluhuwe and Mtubatuba after driving from Mozambique.

The convicted men identified her vehicle at the border post and dragged a chain with spikes over the road, which blew out her tyres.

A gang of five pulled up behind and forced her from the vehicle at gunpoint, robbing her of items to the value of R266 000. She was also raped at gunpoint. The hunt for the two other members of the gang is still ongoing.

The matter was remanded for sentencing to 17 March.
