A MTUNZINI detective is preparing to sue the State for wrongful arrest and prosecution.
This after the Mtunzini Regional Court declared there was nothing linking him to the case for which he was being charged and dismissed the charge on Monday.
Thalente Nxele (35) of eSikhaleni was arrested in April this year and charged for the attempted murder of his ex-girlfriend, Nokukhanya Ngema.
Ngema was attacked and shot twice in her upper body by unknown gunmen at her home in Port Durnford in February.
She mentioned Nxele as a suspect, but he distanced himself from the allegation.
‘I spent 52 days in police custody. I was arrested on 9 April and released on warning on 30 May.
‘My dignity and reputation have been badly tarnished, as I was accused of a crime I did not commit,’ he said.
Nxele said the State did not oppose bail but the prosecutor postponed his bail hearing several times without any valid reasons.
‘Those are some of the issues that make me believe there was more to my case.
‘Police were quick to arrest me without any concrete evidence and the regional court allowed the matter to be heard in court, knowing exactly that there was no evidence linking me to the shooting,’ he said.
