iNkosi demands R1-million for ‘wrongful’ arrest

THE head of the Madlebe Traditional Authority, iNkosi Zenzo Khulumangifile Zungu, is a frustrated man.
Apprehended in March 2015 for conspiracy to commit murder and with his trial still ongoing, Zungu’s lawyer has now submitted a letter of demand to the Minister of Police, claiming damages of R1-million for wrongful arrest.
He is also claiming R70 000 for legal costs and R55 000 for alternative security measures he had to hire in after the ‘unlawful seizure’ of his and his company’s firearms by police. Speaking through his attorneys, Strauss Daly, Zungu said he will not rest until ‘justice has been done’.
‘I have written to the national Minister of Police Fikile Mbalula, demanding a payment of R1.125.000 plus interest on the damages incurred during my arrest and detention which infringed on my constitutional rights to liberty and dignity.
‘Failure to comply with this demand will result in the institution of legal action,’ Zungu warned.
The letter of demand stipulated a 30-day deadline for payment of the damages. It further claimed Zungu was arrested without a warrant at his office in Nedbank Building, Empangeni by members of the SAPS on allegations of conspiracy to commit murder and attempted murder.

Humiliated
‘Given my position and community standing, I felt humiliated when this arrest was effected.
‘It was made a public spectacle in full view of my employees.
‘They detained me at the Durban Central Police station until I was brought to Empangeni Magistrate’s Court on 16 March 2015 and was granted bail of R1 000,’ Zungu said.
The attorney’s document stated the police arrested the iNkosi notwithstanding the fact that he was 52 years of age, had been an iNkosi in Empangeni since 1998, was not a flight risk and that the offence in question had allegedly occurred in February, 2006. It said a less drastic method of securing Zungu’s attendance in court could have been used.
‘In consequence of my arrest and detention, I suffered humiliation, emotional stress, deprivation of liberty and impairment of dignity and reputation,’ said Zungu.
‘As a traditional leader and a businessman I find it hard to continue living my life with this cloud hanging over my head. I may have no option but to take this matter to the High Court.’
His next court appearance is scheduled for March next year.
