AFTER raping three of his siblings on three different occasions, a young KwaMbonambi man, who cannot be named due to his relationship with the victims, has eluded jail time on grounds of ‘infirmity’.
During the 18-year-old’s sentencing the Empangeni Magistrate’s Court on Tuesday ruled leniently, citing that his ‘state of mind was shown to be not fully developed’ based on his academic records and social workers’ reports, which proved he was exceptionally ‘slow to learn and understand’.
The defence also cited this prior to sentencing when submitting that the accused, who is still completing Grade 8, be placed under correctional supervision at a trade school in the province.
The prosecution did not object to the submission.
However, the court handed down a three-year prison sentence in light of the accused’s coming of age, but kept him out of prison by wholly suspending the sentence.
The incidents took place in KwaMbonambi during 2013, and were discovered when victim’s strange behaviour was noted by their school principal.
The victims were aged seven, 11 and 12 at the time, while the accused was aged 15.
